View Full Version : Two Friends Had a Fight. Help Me Sort It Out.

So I have two friends (friend A and friend B) who got into a fight last weekend. The events went as follows:
A and B and respective girlfriends went to a concert and drank. After the concert, just because of where people parked, A and the two girls (who are also close friends) rode home together and B rode home alone. This pissed B off and he sent 'Fuck you blah blah blah' texts to his girlfriend and A during the ride home.
A and the two girls got home before B and were relaxing when B got home and started talking shit to A and A's girlfriend saying, 'fuck you and you're both the reason my relationship with girlfriend B isn't working because you two talk shit, etc.' A claims he felt threatened for himself and his girlfriend so he got in B's face and proceeded to hit him once in the face. B then got in his car, drove around the block, came back, and went after A, resulting in a normal fight where both were hit a few times but no real injuries. The fight is broken up and a few minutes later while A has his back turned, B comes after him again, the fight ensues, punches are thrown, and results in A restraining him until everyone calms down. Everyone then goes to bed.
All in all, A suffers a broken hand (not sure if it happened in the initial punch or sometime thereafter) and B suffers a pretty bad black eye but no broken bones or permanent damage (again, not sure exactly when in the fight it happened). Both go to different ERs the next day for treatment. No police reports are ever filed. Both apologize to each other and the girls the following day after returning from ER and things return somewhat to normal.
Today, B contacts A asking him to pay his hospital bills. B has shitty insurance and does not think they will cover any of it. He does not yet have a final cost, but estimates it to be a few thousand for the ER visit and CT scan. A has good insurance and expects his bills to be covered.
A is now afraid that if he doesn't pay, that B will file a police report or try to sue him in civil court. A is also afraid that B's insurance company will come after him for damages.
Does B have a case? Should A pay him? Are they both guilty of assault/battery or only A, since he 'won' the fight and swung first? Is B's threatening demeanor toward A and A's girlfriend enough to justify swinging first?

At first I was feeling sorry for B, because he's clearly a loser on the pay-no-mind list if his friends and girlfriend are willing to just ditch him after the concert. He should have taken the hint and dissolved the friendships with some class.
But then he started acting like a bitch, he got punched, and instead of fighting back he ran away and cried in his car. Then instead of just accepting the loss, he comes back and tries to save some face by throwing sucker punches. What a faggot.
If he wants any money, A should be a heel-dragging mother fucker. Make him go to court. I can't imagine anyone in your group still likes B, so you all should just lie and say A was acting in self defense. Counter-sue for A's medical bills.
Fuck B right in the face.

Well B and B's girlfriend drove separately so they had to ride home in different cars anyway. Obviously A's girlfriend was going to ride home with her friend. A rode to the concert with the two girls so he said he just naturally rode home with them. B was really just being a drunken crybaby at that point in my opinion.
It was only the 4 of them at the house afterward, so no one else from our group was a witness. I'm just reporting what I've been able to piece together from talking with the 4 of them.
I think A is mostly afraid since he swung first.

If I was A or B, I would think about being cool and calling it good.
If I was an alcohol company, I would also start selling xray machines and owning ER's.

Yeah I think A and B are mostly friends again, the issue is now who should pay B's hospital bills. A is afraid B will escalate the situation if A doesn't pay.

Bottom line for me is, (A) swung first. (A) crossed the line and took it too far. (B) may be a Bitch, but he did not go to the Cops and he was punched. A should help out B. Either way, that friendship is over, and should be.
At no point, should Police get involved. If B goes to the cops, fuck him.

Yeah I agree with all that but the situation has the potential to move beyond street justice. I was hoping to get some responses as to the actual legality of the situation.

I think the solution is clear: You must cut "Girlfriend B" in two and give a half each to "Friend A" and "Friend B".

The actual legality is that it is a civil matter, likely small claims, and those trials depend on so many variables, there's no reason to even speculate what could happen.

I really have no idea how a lawsuit would work out, but I think the longer your friend lets this go and the more time he lets pass before he files a report the less likely he's got a case.
If he doesn't do it while it's fresh and the injuries are still visible, it's not really gonna matter.
Even if he does file a report and takes it to small claims, it's gonna be some guy and his girlfriend's word against some other guy and his girlfriend. They were all drunk. I don't see that going very far, but strangers things have flown in court.

If the cops were called, I imagine what would happen is they would take statements and a report would be made. Then it would be up to your two friends to work it out in civil court. A threw the first punch, but B was the instigator. Therefore I feel B is responsible for his own bills because they share the blame for what happened that night.

As Satcam said, reports would be made but then it's my drunken story vs. yours, who is more credible?
If you were called to testify in the trial between your friends, who would you say is more in the wrong?

I can't decide that why I asked for opinions. I pretty much agree with SatCam, that it would be a wash as far as blame goes. I tend to think that if B got the cops involved that it's possible both could be charged with assault/battery/disturbing the peace/public intox/etc. Therefore B is better off letting it go and just biting the bullet for his own bills.
