failed drug test

I am a security guard at a mall, i actually work for a company that has a contract with the mall. We recently lost our contract which expires at the end of february. the new security company that is taking over made us take a drug test which i failed, my question is weather my old boss can fire me from the old company for the failed test. The drug was pot and i occasionly drove the company truck. Will i still be able to collect unemployment?i live in ny.

it depends on the employer, what they put down as the "reason" you were let go, and how they handle the phone call they will get from unemployment.

it IS possible to receive unemployment if you have been fired... but it would help if your boss spoke well of you in the interview. you might want to reach out to him... try to feel him out and see if he will be ok approving unemployment.

yeah he pretty much hates me, i had 2 days notice for the test. it wasnt against any policy at my company to to even take a drug test thats why i dont see why they could fire me.

Tell them to retest, that you couldnt have failed and that you quit doing drugs years ago, or be like a friend of mine and say you just have an addiction, he did that after an accident at work, started to go for the drug test he told them he had an coke addiction and he was sent to rehab instead of being fired.

Most of the tests used today test for things like golden seal. And I once paid 50 bucks for one of those cleansing things. All it did was turn my piss green and I still tested positive.

Exactly, the simple dipstick method we used since 1997 is sensitive enough to test around most methods thought to clean you out.

So what if it tests for golden seal, there are plenty of other uses for that herb and I have never had a problem as little as two years ago, besides 2 days should have been plenty of time to get down to testing levels. Still if you stopped smoking once you knew about the test I would just deny it completely then ask to be retested.

And in these tests, I don't remember what the measure/subtance was but if you try to dilute your system drinking plenty of water or other fluids, the increase in this substance in the drug screen will flag your testing result and who ever is reading it will surmise that the person was trying to mask his/her drug use.

THC is stored in our body's fat cells. Golden seal is a diuretic (dehydrates you) which will also reduce some of the fluid in the fat (some diet pills work the same way, reducing water weight). By doing so is reduces the amount of detectable THC. But today's tests are sensitive enough to test around that. They do not test for herbals such as Golden Seal, but the test can pick up minute traces of illicit or certain prescription medications.

hahahaahhaah, yeah i went in on monday and he tried to get me to resign but i told him no. I had to turn in my key and i am now off the schedule. so I am just concerned that I will not receive my unemployment benifits....

In some cases, you have to sign a release that states that testing positive for known masking agents will be counted as being tested positive for drugs. This is especially the case in probation/parole situations, but can also be used in business. Not signing is cause for dismissal.

While I'm sympathetic to the guy who lost his job your post/suggestion pisses me off. It just perpetuates the whole attitude of people refusing to take ownership for their actions and instead look for a crutch which ultimately fucks up our whole society. With all things in life there are responsibilities, risks and rewards. If you can't comprehend the relationship of all three then either pick something else (be it a job, recreational activity, etc.) or be prepared for the consequences if you fuck up.

I like pot, I mean I REALLY like pot. Nothing better then downing a couple of special cookies baked with some of BC's finest and giggling like an asshole for a few hours. However, because of a commitment I take on every winter where random drug testing is part of the program I don't indulge from November to April (which might account why I'm in such a foul mood these days).

I have a feeling, if they tried to get you to resign, they may feel that firing you will allow you to get unemployment benefits. Otherwise, why wouldn't they just fire you outright? Stick to your guns and don't resign.

One time, I was tying off with a joint in my mouth when I was taking a drug test for work. They told me they had to let me go. So, I snatched my supervisor's wallet and said "Unemployment accepted!" and stormed out. I will never work at an orphanage again.


You need to be "laid off" in NY State to collect unemployment.

I know more than a few people who passed the wiz quiz by drinking a ton of water - a b complex - and by not using any of the begining urine or end urine - only "mid-stream" urine - which is aparently the hardest to detect anything in. These guys were also on parole so they had a lot on the line...
