I have to agree that Pierce didn't exactly know what he was doing, but he's cooperating with police to avoid being charged.

I would say that the Giants suspend him for a game and that's it. What Pierce did was no worse than what Kareem McKenzie is accused of doing, and perhaps was Kareem did was even worse.
