I just read on WWTDD that he's not going to be charged w/ anything.
According to the DA there " wasn't enough evidence ".
I guess refusing to take the breathalyzer didn't mean anything.

i always thought that the fact that you refused to take a test was an automatic guilty and grounds to get your license revoked.

Refusing the breathalizer has no bearing on how you plead but they DO take your license away until the case is resolved. I was on the jury for a DUI.

Yeah I'm guessing he probably did lose the license for 6 months to a year but further charges would've included community service, fines and possible jail time.
Apparently some other guy ran a red light and hit him.
I bet that guy, drunk or not, is facing charges still.
