Pennoyer v. Neff (S.Ct. 1877)
Facts: Mitchell brought an action against Neff in an Oregon court to
recover legal fees. By publication he served Neff, a nonresident, and
obtained judgment by default. Thereafter, Neff learned of the sale of
his property in Oregon to satisfy the judgment. He sued Pennoyer,
the purchaser, in Oregon to recover his property. Neff argued that the
Oregon court had no jurisdiction over him.
Issue: Is service by publication sufficient to give a state court in
personam jurisdiction over a nonresident?
Rule: (Field, J.) A personal judgment against a nonresident served
only by publication is invalid. For personal jurisdiction (as opposed
to in rem jurisdiction over property) the defendant must come within
the court’s jurisdiction by personal service within the state or by
voluntarily submitting himself to service of process. In rem
jurisdiction may be achieved by attaching the in-state property of an
out-of-state defendant who otherwise could not be brought into the
jurisdiction by in personam jurisdiction.
Dissent: (Hunt, J.) The states have the exclusive power to determine
what notice is required to prospective defendants. As long as that
notice is “reasonably likely” to communicate notice of the suit, is
made in a good faith effort to notify him, and the defendant receives
an opportunity to defend himself, the notice statute should be valid.

It will be another 2½ months before any team skates around a National Hockey League rink, hoisting the Stanley Cup in triumph. But the Buffalo Sabres already can claim they’re No. 1 — in an ESPN The Magazine ranking of all 122 major professional sports franchises.

Called the Ultimate Standings, the listing ranks pro franchises on how well they pay back their fans for all the time, money and emotion fans invest in their teams.

“The Sabres score big in our fifth survey of how pro teams pay back their fans — and teach the rest of sports a lesson on stoking the faithful’s fire,” states the sub-headline of the story, being published Wednesday.

That lofty ranking comes just four years after the team was mired in bankruptcy, with both its ownership and its future in Buffalo clouded in uncertainty.

Here's a lowlight that many of you didn't see during last night's broadcast of the All-Star festivities at Yankee Stadium -- former Mets manager Willie Randolph arriving with his wife, Gretchen, as the guests of George Steinbrenner.

While it was nice of The Boss to invite one of his favorite players back, Randolph showed zero respect for any of the writers that covered him during his three-plus years in Flushing -- and more than a decade before that in the Bronx -- by completely ignoring them on his way into the building.

OK, so Randolph is still bitter over his firing. And maybe the fact that the Mets are in the middle of a nine-game winning streak that has them just a half-game out under the guidance of his former bench coach, Jerry Manuel. That's understandable.

But then why even bother showing up at the Stadium, where you know reporters will be waiting to talk to you. And perhaps the worst of it all was Randolph acting oblivious to the half-dozen reporters walking with him through the gate. Not even making eye contact. Simply pretending to hear or see nothing.

There was no "I'm not talking tonight, guys," or "I'm excited George invited me back." Nothing. I've been treated far better by Barry Bonds, Roger Clemens and whoever else has been painted a villain in the media. Joe Torre was not thrilled by the way he was dumped by the Yankees at the end of last season, but his dealings with the media have never been affected. He may not always be overjoyed to speak with reporters, but he is always professional. Torre gets it.

Here's a news flash for Willie: None of the beat reporters fired you. I guess we'll all just have to wait for the book -- Randolph signed an exclusive deal last year with Daily News reporter Wayne Coffey -- to know if he enjoyed last night's All-Star tribute to Yankee Stadium.
