<p>If the law is still on the books, and is being enforced, then it doesnt matter what it says.</p><p>To allow her to sue because she was given a ticket on something that was declared unConcsitutional would allow for anybody to sue.</p><p>Allow flag-burners to sue the police who arrested them, allow anti-abortion protesters to sue cops for removing them from rallies tjhat are later deemed within their rights, and on and on.</p><p>But I see why this is so important. Clearly George Bush wants anybody with a sticker like this sent to Guantonomo and this cop was the first to take the necessary steps.</p><p>If the bumper sticker was " I LIke 15 Year Old Boys " you think it'd be treated the same way ?</p>

<p>That was my point in regards to why is this a big deal ?</p><p>It probably happens 100 times a day for similar cicumstances.</p><p>What we didnt read was maybe this lady was a bit of a jerkoff and talked herself into an additional " bonus " ticket.</p><p>I fing it hard to believe that the cop pulled her over soley for the bumper sticker.</p>

The law was deemed unconstitutional, was presumably removed from the books, but the lady was ticketed anyway. She was punished for a law that doesn't exist - it is an egregious error on the part of the officer and the county/state for not immediately overturning her ticket. <br />If the law was still on the books, the lady has an even stronger position. The law was deemed unconstitutional 16 years ago and never removed – obviously an error by the state/county. You can’t keep a law if it’s illegal.<br /><p>I hate the fact that this lady is suing for damages, but in terms of law she is in the right. </p>

<p>Thats incorrect.</p><p>Laws get changed and ammended all the time so do you think they send police officers back through the academy every year to relearn them ?</p><p>Between a state court over-turning a law and a legislature tweaking them every session cops would be in class all day.</p><p>Plenty of cases get thrown out of court once the police make arrest and or ticket the violator.</p><p>For example there are always always on the books, say in Boston, that are still there from the 1700s, that havent been removed, for which you'll never get a conviction.</p><p>It doesnt mean the police cant ticket you for them.</p><p>As I stated in a previous post she more than likely got the ticket for being difficult.</p><p>Much like tickets for window tint being too dark, tires not being inflated to the acceptable level, etc ...</p><p>Or he could've stopped her to see if she was drunk and then used that as his probable cause.</p><p>I dont care how staunch of a Bush fan you are you're not gonna stop and ticket somebody just for that.</p>

Where's the distress?</p><p>Now, If she had been handcuffed, thrown in jail, lost wages, and raped all due to the "poisonous tree" of the original bad summons...ok....id see the need to sue. But as this story goes, she received a piece of paper from a cop which turned out to be a piece of nothing.</p><p>She's not alleging that the cop said anything about loving Bush so youre getting a summons for not loving him, just that he mistakenly thought the law still existed. excuuuuuuuuuuse meeeeeeeeeeeee!!!!</p><p>She should however now be found guilty of filing a frivilous lawsuit.</p><p>Oh yeah. Thats legal too. Ridiculous. </p>

Wow dont these cops have anything better to do like stop actual crime? Or were they too busy doing nothing so to make it look like they were busy they gave some lady shit for no reason. </p><p>From your name on here I'm taking it your a cop so to you its nothing, but you to us regular people who get pulled over for nothing and have to take off work or go to court to fight something because the cop wasnt doing his job correctly well that sucks. Plus I do believe there is some stress involved. When people get pulled over by a cop, especially when they did nothing wrong, they get very nervous because they dont know whats going on and what could happen to them.</p><p>But like I said I wouldnt sue but maybe the cop should pay a fine or be tickets for being an asshole.</p>

Now there may be 10 other people doing that at the same time but you can really, w/out the help of a roadblock, stop one person at a time.</p><p>People who get tickted for going only 10 miles over the posted limit cry quotas but while the officer may be tallying number he surely didnt entrap you. You were speeding.</p><p>Trust me no police agency wants to stop people for going such a small amount over the limit but if they do they are within their rights.</p><p> </p>

The fact that she got pulled over for having that bumper sticker is what amazes me most. I know in NJ you couldnt be pulled over just for not wearing your seat belt. You had to be pulled over for a moving violation and if you werent wearing your seat belt then you got a ticket for that as well. This may have changed in jersey but you couldnt be pulled over for something so stupid. </p>

Or even Basic Civics class 101. </p><p>This woman is hiding behind the political content for a sticker which was (at one time) illegal. Maybe the cop made an honest mistake. Maybe he's an arch right winger being an asshole. Either way, the system worked, end of story. </p><blockquote /><p> </p>
