In a nutshell...the music industry is asking congress to enact laws that would outlaw the recording ability of XM's radios. They are asking for increased rates for royalties as well as fees for each radio sold.

These links are directly from XM's website to petition your congresspersons:

http://www.xmradio.com/grassroots

http://www.xmradio.com/grassroots/sira.jsp

http://www.xmradio.com/grassroots/perform.jsp

These are articles concerning the situation (also from XM's website):

http://www.businessweek.com/technology/content/jun2006/tc20060621_373696.htm?sub=techmaven

http://www.usatoday.com/tech/columnist/andrewkantor/2006-05-25-music-industry-xm_x.htm

http://www.rockymountainnews.com/drmn/editorials/article/0,2777,DRMN_23964_4735797,00.html

The RIAA is an irrelevant organization that sees potential profit loss due to new methods of distribution. Younger generations see music as a medium rather than a product because of the advent of napster and other p2p networks. Had the RIAA got on early on and really used it to promote rather than try to bock it, we'd be in a much better position today.
This would be an interesting case if it makes it that far. The grokster case was always going to fail. The Supreme Court rarely treats people or business with illegitimate interests with any favor. The case for XM is very strong as a legitimate business utilizing current technology to futher its business. This could be a the definitive case in digital rights.
I think XM is in good standing, This case has already been tried a few times. BetaMax, VHS, Audio Cassette, and there might even been some pissin an moanin about CD/DVD recordable media at one point. The RIAA and MPAA have always hated the new technology. Its amazing that people can stiffle innovation to satisfy their own monetary goals. I wish people would value progress more than the dollar. They always scream piracy or the like will be their downfall (RIAA that is) and the reality is its their shitty business practices that will be their demise.

The argument in that one was mainly the idea of time shifting, or recording, programs from a legitimate source. So in grokster they differeniated it and said because grokster server was an illegitimate source of which to get the music the cases were different and the betamax holding wasn't applied. The Grokster holding was applying to "one who distributes a device with the object of promoting its use to infringe copyrights". So I'd hope XM wouldn't fall under this category.
Welcome to the Corporat-ocracy.

When do we pick up arms over the corporations ruling us. i didn't sign up for this shit.

There is a tale during the French Revolution that I admire. When the Poor/Hungry French got fed up with the lords of the land during their Revolution, its said that one group went to the mansion/villa of their "master" and drug him and his family from their home. They killed his children in front of him, then raped and killed his wife in front of him. Then they proceeded to cook the fucker on a Spit over and open ire... and ate him. Maybe we should start a similar program.

Now I'm starvin'.
