View Full Version : Apple Sued Over Potential Hearing Loss

<p>A Louisiana man claims in a lawsuit that Apple's iPod music player can cause hearing loss in people who use it. </p><p>The devices can produce sounds of more than 115 decibels, a volume that can damage the hearing of a person exposed to the sound for more than 28 seconds per day, according to the complaint.</p><p>The iPod players are "inherently defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss," according to the complaint, filed Tuesday in U.S. District Court in San Jose, Calif</p><p><a href="http://news.yahoo.com/s/ap/20060202/ap_on_re_us/apple_ipod_lawsuit">http://news.yahoo.com/s/ap/20060202/ap_on_re_us/apple_ipod_lawsuit</a><br /><br />Heaven forbid a device is made that is useful without some bullshit lawsuit. <br />This one takes the cake. For me personally if the volume is too high, I simply lower it to an acceptable level. It's a no-brainer. </p><p>The flip-side to the argument that this is too loud is that if the ipods volume is too low then it will be something that is not useful for people with low hearing or some degree of hearing loss. So the ipod and other mp3 players is made to be useful to many different people whether they can hear fine, or otherwise. </p>

See I don't even understand the earbud argument either. I mean the ipod comes with earbuds though by no means do you have to use them. I use other earbuds and headphones at times. The issue of the earbuds though is pretty much inherent in any earbud so it's not really exclusive to Apple.

Well, I'm not saying this lawsuit is legitimate in any way. But I don't see how they can prove the iPod is "louder" than anything else used with headphones or earbuds or whatever.

<p>Hbox hit it right on the head.</p><p>How in the f'ck will the "victim" here explain that his hearing loss is specific to an iPod and not some other device that requires headphones? </p><p>Having said that...the headphones that come with ANY portable player are always inexcusably bad. People really do feel the need to crank them in order to get any "punch". </p><p>I have expensive in-ear headphones that block out 29 decibles of outside noise. The volume on my iPod is, sometimes, as low as it will go (depending on my environment) and the fidelity has to be heard to be believed. </p><p>If getting some serious sound out of his iPod was so important to this idiot, he should invest some money into some real gear. </p><p>Do a little research...you fucking jackass.</p>

<p>That's a very good point. How will he prove the iPod did it, and not a gunshot next to his head, working on a construction site, playing in a band, standing too close to a speaker at a concert, standing next to a diesel bus or ANY other number of circumstances in the world where you are exposed to loud noise.</p><p>We all know he's just hoping Apple tosses him a few grand to shut up. I hope they battle him until he's broke. </p>

I fucked my hearing the first club show I went to when I was 17 - 4 days later, ears were still ringing - still ringing today. I also listened to headphones with the audio turned all the way up, which I'm sure made the matter worse. 20 years later, the ears still ring - really sucks.

<p>I have a slight ringing in my ears from construction, headphones and METAL in general.</p><p>This guy did something REALLY bad if he seriously did something to his hearing with earbuds. He must have listened to them on full blast for days.</p><p>Or he's bullshitting, which is what I'm gonna stick with. </p>

<p>Two things the guy has working for him is that he's suing specifically over Apple not providing an adequate warning over potential deafness and he's suing in California.</p><p>Semantics about warnings and the California judicial system usually work to the benefit of these kind of lawsuits. </p><p>On a personal note/rant, I fucking hate the earbuds and refuse to wear them, be it with the iPod or my MyFi. </p>
