Is anyone else outraged by the fact that the police and the military are now doing random searches and forcing people to open their bags before they get on the subway? Is this constitutional? Do you think it will actually do anything to prevent terrorism?

We live in a police state now so until our government gets overthrown, we will be needing our papers to pass checkpoints and may even have to start bribing police like they do in 3rd world countries.

-BULLETIN- The terrorists won!!!!! Airports already had pretty tight security before 9/11. You can't compare that with a MASS TRANSIT SYSTEM that has never had any type of secuirty in the past. Also a airline is a privately owned entity whereas the MTA is paid for and operated by the public.

If I was a suicide bomber I would run right at the police. Or even run past them into the closest crowd.
OK, I get it, these searches really get your panties into a bunch.

And yes, I can see how they're going against our basic rights.

But bag searching doesn't bother me. Because when a suicide bomb goes off in NYC, and it will, will it be on a bus or train that you are on? Maybe not, so then it's at the front door, killing police officers and other innocents. It's a no-win situation. I don't want to see anyone die but it's about survival. I want to live. And if a bag search causes the bomb to go off away from me - all the better I say. Yea, it's selfish - but I don't want to be blown up for some f'n allah or whatever god that doesn't even exist.

The bag searches will stop in time. Just like the checks in the tunnel. Until the next bomb goes off - here or in England - and then it will start again - then die down again. We'll all have to endure these cycle for many, many years to come. Thanks to our current administration.

Suicide bombers are an effective strategy. I just hope we can do all we can to prevent them.

The police followed me into my yard thinking I was someone else and asked me for "my papers". If I didn't have my ID on me I would have probably been arrested in my own home for not carrying my papers. In my 37 years of experience living in America, I would characterize that as living in a police state.

That was the police doing their job. It was your own backyard, so you show them ID and they're on their way. If you didn't have it on you then you point at your house and say it is in there and then you get it. As long as your cool with a cop, there is a very good chance they'll be cool with you.

I've had bad experiences with cops in the past and yea, it sucks, but that doesn't make me feel the whole institution as a whole is f'd up.
I say, open up the subways. totally open and unfettered
access, but
liter the city with cameras. it's thru the cameras that scotland yard
has made those arrests so quickly. Keep in mind, London has been hit
twice in 2 weeks, and they have not begun subway, sorry "the Tube",
searches. The searches are window dressing, to get the publics
confidence back into the transit system. We need an answer, not a show.

screening is only effective if everyone is searched. Random searches,
while a nice idea does not secure or sterilize an area. so to have the
majority of people in a transit system unscreened still leaves it
vulnerable to attack. the MTA or TSA could never institute a screening
system to sterilize the subway system. Cameras also leaves the system
vulnerable but it greatly furthers the investigation if we were hit.

Thanks Furie - that's sort of what I was getting at.

The other point I trying to make was that if we violate people's rights based on race or ethinicity, it's somehow wrong, but if we violate EVERYONE's rights, it makes it okay. Let's just cut the bullshit and search all the muslims trying to use the train or bus. That's obviously who they're interested in anyway. But if they came out and said that, suddenly they would be viewed as the bad guys so they disguise it by searching EVERYONE and inconveniencing EVERYONE.

I had to wait an extra hour for my passengers to go through security.

But that's besides the point.

Everytime we make a decision like this, we have to weigh whether the added security is valuable enough than the rights given up. checking bags will do nothing to thwart terrorist-- I can think of a million ways to get by that. but it does infringe on our protection against Illegal Search and Seizure, i can tell you now, next time I'm down there if they ask me for my bag, I'm asking for their warrant.

one more thing: I circled Penn station for half an hour yesterday, and then parked in a no parking zone right in front for half an hour. I would've made a very effective car bomb. If they want to improve security, they should start there.

best deter that one bomber for a short while. But a camera will aid the
investigation greatly. identify the bomber, allowing for links to be
traced back to his cell, getting at the roots. With just a few cops in
a subway entrance, no evidence will be collected (i doubt this guy's
dna's on file and CBP only recent began to fingerprint incoming
visitors), that same bomber is dead, and we'd be no closer to stopping further attacks.

deal with it.

if (big if) things get better, it will go back. or if the murder rate goes up, tourism goes down because of this,or the funding for the PD goes over budget it will also go back

if it does not go back there will be a revolution because regardless of your politics, nobody wants a police state and the people will reject it.

if they don't get better, some fringe american group from the midwest will go and start doing the same to arab countries, and it will be ww3 but all guerilla fighting.

Mike, you're being way too literal. No one is comparing this to Nazi Germany 1939 and no one really thinks that we're living in a police state. It's just a phrase that's being thrown around to illustrate how offended people are by the actions of our government.

I dont think thats cynical at all. I think thats good sensible thinking.

How
about the 50,000 people who die per year in auto accidents? You have a
FAR greater chance of dying in a car wreck than by a terrorist. But you
dont see people in a panic over cars, do you? Its about what level of
risk you become accostomed to. Terrorism scares people because its the
"unknown" risk, even though its actually a remote one, and they take
bigger chances every day. Its really a massive overreaction on our
part. I understand the Governments desire to make us "feel" safe, but
in all honesty there's no such thing. I loved the Brits reaction to the
bombing. Some mourning, some tears and then right back on with their
lives. But they have more experience w/this than we do.

I was arrested in my garage because he saw a bong on the shelf. Subsequent searching revealed a small bag of pot. Yes I broke the law, but this law is stupid. I wound up not being convicted because of the illegal search, but I lost ALOT of time, money, pot and a bong. I donate alot of my time to activism trying to change our draconian drug laws because it is a waste of time that should be spent on "weeding" out suicide bombers. The pot laws are bad enough and the Drug War is escalating exponentially. These misguided searches will do NOTHING to stop a bomber. They will however generate more fear which our government needs to implement their big brother prototypes. This is going to be revenue for our government, that's the bottom line. Thousands of people will be arrested for OTHER things because of these searches. My friend was a medical marijuane patient that had her pot taken away and arrested. Was the government looking out for her health? I don't think so, they just want money.

Are they going to search buses too? Are they going to place a cop on every bus to randomly search people? What about searching everyone who enters a mall? Post office? Restaurant? Movie theatre? Schoolyard? Let me tell you brother, even that wouldn't protect us from these crazy ragheads. Is that how you all want to live? Do you realize what that kind of "lock down" security will cost? It's the cost of living in fear, which I chose not to do.

My answer is to legalize pot and use that tax revenue to pay for your "lock down" style of security. Then the rest of you can feel safe and the police can look through my big bag of pot all they want.
FLING FLING ........... SPLATT SPLATT PUTTING THE FUNNY IN PRESENTLY SEEN DEPTHS SPONSORED BY:"THE FÆCES™OF CÆSAR" BY ÆSOP ©464 B.C.

Well, it looks like some here do indeed think we are living in a police state, but the examples given so far, are, well, laughable.
YOu have to look between the rants here. When 10 million people are killed for disagreeing with Stalin, we can call it a police state. But when America, a country that places so high a value on personal freedom, starts to fence in those freedoms, then that's what its gonna feel like.

=

No.

Back to the front...

When I envision 'Police State' I am envisioning past events in say the last century; places all over the globe, where it's happening now, right now, where whoever runs the Gov/Police has total control; people who are unfortunate to belong in a certain area or a certain group are rounded up and disappear. Places where human rights simply don't exist at all, where people have absolutely no one to go to but themselves.

Yes, we can point out the long, dreary history of abuses by police and the CJ system; and it's a pretty bad history, but I would argue that in many ways, we enjoy freedoms, and avenues for the establishment of truth and the provision of justice, that past Americans only dreamt about.

=

And I am loathe to even bring it up, I'm weird that way, go figure me out, I can't, but the bombings in London, and in Spain earlier [if anyone hasn;t checked out That carnage, yow... horrific... the ETA is FUBAR], lead me to believe that one day I'm gonna hear it: Some slimebuckets blew themselves up in some US city, with massive deaths and casualties. I really hate even hypothesizing, but there it is, and for me, that's a nightmare I don't want. Ever.

So, as for where the 'slippery slope' [stupidest term ever, but hey...] is between total freedom and Anal Probes, I'll admit this; I have no friggin clue. I'm just the guy who is thinking, perhaps over-thinking, some real nightmare worst-case scenarios.

=

Lastly, I wouldn't legalize, I'd massively de-criminalize, but most of all, get rid off the asinine, inconsistent, anachronistic minimum mandatories and three strikes BS for drug related offenses. Amazing the percentage of the prison population in on small/medium busts, and that just plain sucks, and worse, is simply wrong. It does nothing. Nada.

Although I agree with DJ EvelEd's point of view, I don't think the examples he used have anything to do with the what's happening in our subway stations. Police tactics and the ways in which the police infringe upon our individual rights is one thing. I'm not a cop and I wasn't there to say whether or not they went outside the law. But what happened to DJ EvelEd seems to be an unavoidable product of police work.

If the police are investigating a crime in your neighborhood and come across a suspicious looking person skulking around in someone's backyard, they have the responisibility to ensure that nothing illegal is happening. It would be irresponsible of them not to. Similarly, if the cops walk by your house and smell smoke, there's nothing wrong with them knocking on your door to make sure your okay. You shouldn't take offense to those things because they are most likely doing it out of concern for your safety and the safety of those around you. Not to jam you up on something for no reason. I'm sure there are cops who do that and instances of that happening, but I'd bet that most are more responsible and are doing it with good intentions. Unforetunately, if a cop comes to your door to ask you about something unrelated and he happens to see a bong or a stolen Monet or a 14-year-old hooker, he has the responsibility to do something proactive. He can't just turn around and ignore the situation and unfortunately it's still illegal to smoke pot.

This happened to me a few years ago when I was driving with a friend of mine in New Hampshire. My friend rolled through a stop sign, a cop pulled us over, and as he was asking for his license and registration, he detected a hint of weed, which we had smoked a while earlier. He dragged us out of the car and asked us if he could search the vehicle. Since we didn't have any more weed on us and since they would have searched it eventually anyway, we didn't protest and the cop ended up finding a bowl under the passenger seat. My friend was immediately arrested and since he was from Maine and the offense occured in New Hampshire, he was charged with drug-trafficing paraphanalia (sp?). It was a ridiculous charge and were pretty fucking pissed. But you have to accept that if you break the law and you're caught, even if it's during the course of another investigation, you deserve to be arrested.

That's what makes the subway searches even more dangerous. There's an instance where people are being interrogated indiscriminantly and without justification. It's not even about police work - it's about policy and containment. It's about what can the government do to make us all feel a little better about using the subway, regardless of the consequences. If they saw a real a serious threat in the near future, why would they stop at the subways? Why not stop people on busses or in theaters or on bridges and tunnels? The answer is because there is no real threat and there is no justification for the actions they're taking. We may not be in a police state now, but we are definiately heading in that direction and losing more and more freedom every single day.

Besides the steady erosion of our rights, one of the things that pisses me off about all this is the sure knowledge they will cock it up.

Hell, they can't even run the x-ray at the airport in a way that inspires any confidence.

About two months ago, I took a flight on Northwest out of Washington/Reagan National airport.

The person in front of me put two bags on the belt for the scanner, and both went through without the "security" person even glancing at them, but that's not the worst part.

Why?

The bitch was too busy flirting with the asshole guy who alllegedly was watching the x-ray arch you walk through, sans shoes. She was turned all the way to one side, exchanging banter with the bastard, who likewise wasn't paying attention to people going through, but that's not the worst part.

The worst part was when I got through there and asked to see a supervisor.

I told the "supervisor" what I'd seen, described the two bags, their owner and the two "security" personell's behavior.

The bitch security advisor told me I didn't see what I'd seen.

So I stood there with the bitch supervisor, directed her attention to her charges, and as the same behavior continued, the bitch supervisor again denied seeing what we both witnessed, that is, the bitch behind the x-ray screen passing bags through the machine and not letting them distract her from the asshole guy who wasn't paying much attention to his job either.

It wasn't until another person went through, his bags unexamined by the bitch behind the x-ray machine, that the supervisor admitted that maybe something wasn't quite right.

As far as I could tell, the bags that were unviewed at the x-ray machine made it onto the planes.
