Maybe you might want to read beyond the first paragraph.
If the "Law and Order" episode story were true it would indicate "premeditation" and Yates would then not be insane.law. So, this isn't some "little technical error" the woman's whole defense was undermined by a lie.
She is never going to go free. The issue was and will be is she to be confined to a prison or a mental hospital.
The jury should be given the choice based on the truth. Not something some expert "made up" So, when you ask what's going on in the courts? In this case it is making sure Yates' gets a fair trial.

When I said what the hell is going on in our courts, I meant, why is a prosecutor invoking television as a reason for premeditation?

She drowned four children, one at a time, and went for a fifth.... you don't get much more premeditated than that!

one, ok, sure... two, possibly... but there were FIVE!

also, why did it take TWO YEARS to find out that this episode doesn't exist... you'd think there'd be a database or something.

to put this woman in a mental hospital is an affront to the other patients, they're depressing and perpetuate further psychosis enough as is.

this is why the mentally incapable should not be permitted to conceive.

but I guess everything is TV's fault.

The prosecution didn't know whether the episode existed or not. It was an "Expert Witness" that lied. The prosecution just relied on his testimony. The two year wait wasn't to determine the existence of the episode it was to give the appeals court time to determine whether or not it was relevant.

I do not disagree that she belongs in jail, but she deserves a fair trial. if the court accepted the fact that lying by a state's witness was okay then it would set a precedent for all future trials. What happens next time when its not so clear cut? Do we say well someone lied, but so what the guy should go to jail anyway.

My point was and is Andrea Yates is never going to go free. Where she serves her time was the only real issue. So, this isn't really going to make a whole lot of difference, but she like everyone else should have the chance to make their case and let a jury decide. "Based on the Facts" Not some made up occurence that never happened.
