An appeals court said a Newark man who was hit in the face while buying a beer at Newark's Riverfront Stadium can sue the Newark Bears and the owners of the food service company.

All the games I've been to, they have warnings posted about the chance of items from the field flying into the stands. Hell, most stadiums broadcast that warning right before the game starts.

you have to consider the guy was 'buying a beer'... noone will watch the hitter at all times...
i guess you have to be in a persons shoes that has the bones in their faced crushed and is facing alot of medical expenses... in some cases the franchise can afford to pay the bills more than the fan... it shouldn't be in the millions but enough to cover the medical bills...

At Yankee Stadium, it's on the back of the ticket, they announce it just before the game starts and again around the second or third inning. Fucking ridiculous.

It's this kinda stuff that has a potential to ruin it for the rest of the fans. This could force stadiums to put up some sorta "protection" for fans in the stands that prevents them from getting hit with the ball, but at the same time ruining it for other people who came to the game hoping to catch one.
People are idiots.

Its on the back of every ticket sold at just about any sporting or concert event. You buy a ticket, you accept the risk.

I can't remember whether or not this happened at Riverfront Stadium (fron all the way back to the O&A softball game) in particular, but no sports building I've been inside of within the last 5+ years has failed to have at least one, if not a combination, of the following:
- A "Watch the tramcar please"-esque looped recording at the front gate as you show your tickets & enter the building.
- Multiple signs around the ballpark.
- Warnings printed right on the tickets (like a user agreement).
- Announcements from the live public address announcer during the action.
Any judge who hears this case beyond opening arguments & doesn't throw the case out immediately should removed from the bench & flogged.

I can't find the article in a search but I did read a couple months ago that a judge threw out a suit filed by a woman who was hit by a foul ball. The judge ruled that she took the risk and the risks are clearly communicated to her.
This was at a MLB game as well.

We were at a Nwk Bears a few weeks ago and sitting front row behind the visitors dugout - woooo! I kept telling my son, who is six, to keep an eye on the game because a ball could come our way any time.
Well, one eventually did and hit the kid next to us really hard in the back. The kid was ok so in the end, it all was pretty funny.

On the back of your ticket, whether sports OR otherwise, there is a disclaimer sayin objects may fly into the stands, including bats, balls, pucks. because of that, you can sue, you can sue for anything, but he will never win

I once went to a Cubs game with my dad, and we had bleacher seats so we went out early before the game to see batting practice. Sammy manages to drive one all the way out to where we are, and one guy runs all the way to the top to try and grab it...sticks both his hands up...is all set for the catch...and the ball sails right between his hands and smacks him right in the nose. It sounded like someone punching a hollowed out pumpkin.
He goes down, his nose is just SMASHED, with blood going everywhere...medical personel are there in seconds, and they get a stretcher for the guy...his nose is of course broken, his cheeks and teeth are kinda fucked up, and it turns out later he had a mild concussion...but even as they were wheeling him out, he held up the bloody ball and managed to mumble, "Go CUBS!" as he was hauled away, just to let everyone know he was OK.

I think the legal term is 'assumed risk'.
You go to a ballpark, and there is a Reasonable Expectation that once in a while, people get hit by foul balls, pucks sailing over the glass, etc.
So, you agree, with said ticket in hand, to assume that risk, and it's up to you to deal with it.
My suggestion is if you really feel that it's dangerous, dont go. Or go to the nosebleeds, where the assumed risk is getting the shit beat out of you by drunken bleacher creatures. Good times!

Yes, I will concede those who sit in bleachers near the field should be vigil against stray balls...but cmon here...at the concession stands? As far as I'm concerned, there SHOULD be areas of the field protected from foul balls...like the concession stands...as one is distracted during the transaction. There's nothing you can do about it. He's handing the money over and KA PLOW, ball in his face. It's not right.
I hope he wins. Maybe next time the stadium will erect some cheap fencing so people can buy thier snacks and drinks without fear of getting whacked by a baseball.
I've been hit with a baseball before, and not in the face...let me tell you, it fucking hurts. What if it took teeth out? Hell, what if it kills a guy?

I said almost the same thing. Everyone is saying the guy wasn't paying attention! The guy was buying a frikin beer. So what do you want people to do when they are walking to the restrooms, walk backwards?????
If someone can accidentally fall on your property and obtain monies for medical expenses via your insurance company then why shouldn't a sports franchise cover a persons medical expenses if they get hurt on their property. Of course they have the note on the back of their ticket saying you can't hold them legally responsible, does it make it right or fair or ethical? Why are stores and other businesses liable? Just another small way the fan gets a cornholing but you know they love it and go back for more...
Hopefully i'm wrong and the franchise will privately pay for the injured persons medical expenses and loss of wages if they are incurred(?)

The disclaimer might help establish the park as being free of guilt, but its up to some judge to decide whether or not the park did enough to protect this man.

Anyhoo the panel ruled that spectators assume some risk of foul balls flying into the stands. However, the judges said fans in concession areas have greater protection because they can "let down their guard."
I don't know about suing the food service company though.

i guarentee he loses, the back of the ticket doesnt say in the stands, but not the spectator area. you are at a baseball game, and btw, when someone yells look out and ducks, a ball should never hit you in the face unless you're a moron

No...i liked his phrasing better...
BlackJeezis kind of phrased it the best at the game in Haverstraw last year. he or someone else on his team hit a shot down the left field line and people on our team were calling it foul so he yells out
"My balls are foul"
then later on he yelled at someone to 'suck his dick' and as he walked past JustJon, Jon says "yuck, no way!" and Jeezis asks him 'why not?' so JustJon replies "cause you got them foul balls"
it was great comedy and i'm not sure if anyone else caught it...
