Good question. I think not because Mel chose to make it in that language.
And the Academy would never nominate that hot potato.

From oscar.org (http://www.oscars.org/76academyawards/rules/rule14.html)
A foreign language film is defined, for Academy Award purposes, as a feature-length motion picture produced outside the United States of America with a predominantly non-English dialogue track.
Icon Productions is a US company, so I guess it wouldn't count.
3. Films which, in any version, receive their first public exhibition or distribution in any manner other than as a theatrical motion picture release will not be eligible for Academy Awards in any category. (This includes broadcast and cable television, as well as home video marketing and internet transmission.)
I found this on page 2 of the rules. I guess that's why "The Hewbrew Hammer" wasn't nominated and didn't win Best Picture! it aired on Comedy Central before being released in theaters, great move!

Actually, CC could have done one private screening of Hammer before it aired on tv, then it would be eligible.

I would love to have been in the room if there was a discussion about being eligible for an Oscar.

Soooooo...so-called "Catholic films" should get a break or free pass? Smells like affirmative action to me, you goddamn hippie...
That said, I think the direction was very good and it should be nominated for at least best cinematography and best director. I don't know about best picture...the narrative and character development is pretty flawed, mostly in that it's "lazy." It expects people to be caught up on everything themselves.
But that said, doesn't it have to be a lock for best adapted screenplay? It made the Bible not horrible! Kudos!

I do have a question though. Was this the year that Big Fish could be nominated? They were nominated for that one thing, but I would think that it should have gotten more nominations.

Big Fish would have been eligable for this past Oscars. It was released Dec 10th and 25th and Jan 9th (NY and LA first, then a few more cities, and then wider in 2004)
It opens in France, New Zealand and Spain this week!

In Oscar terms Big Fish was kind of a big flop.
It seems that even the reviewers were somewhat indifferent to it. While a few gave it high marks for some creative elements, others felt that there just weren't enough of the elements to make it an outstanding film.
Of course it's argueable about the quality of each nomination. But as mentioned by another on the board, it is a popularity contest to a great extent. I personally wasn't that impressed with Diane Keaton's performance. But it seems that any big star willing to go nude gets an award nod (well except for Meg Ryan - but even the voters have their limits).
Big Fish had its best chance at the Golden Globes where it's somewhat disjointed and mythical qualities might appeal to voters of a more international flavor.
Of course, this is just my take on the awards process. Not being an actual voter, I could be completely wrong and it came down to who got the most sexual favors. Either way, I missed out.
