yeah, but no one whos sentenced to life in jail ever gets ass raped, they get preferencail treatment. Why reward them with a free roof over their head, 3 meals a day, unlimmited tv, never having to lift a finger and free heathcare for the rest of their lives as a punishment?

Why don't you ask someone in prison if they consider their treatment a "reward"? The meals and health care meet the most basic governmental standards if at all, the television, if there is one at all, is shared by dozens of other loud, violent criminals, and as for never lifting a finger...they are all assigned to work in one of the prison jobs if they're not thrown in solitary.
Not to mention the horror and psychological trauma of living in a cell and having your freedom stripped away from you for the rest of your life...forced to share your space with the worst of the worst...

good. I agree with jeff that life in prison, without the hope of release is worse than death. besides I don't believe in the death penalty for most crimes. it doesn't work as a deterrent and for the most part, it's not the state's place to enact revenge.

Even if we were talking about indirect self-defense in the heat of the moment, there's a big difference between that and giving the government the power to take the lives of its citizens.

i tend to feel that anyone who commits murder and the act is caught on video should be given the death penalty, being there is no doubt to his/her guilt.
and situations like the 'shooter on the train' in NYC who defended himself. there were many first hand witnesses and there was 'no doubt' as to his guilt.

...then my opposition to the death penalty is just reaffirmed. If one innocent person has been put to death, then that's one too many, and it's become clear that it's been far more than one, even in the last 50 years. There's nothing more horrifying to me than a government that willingly executes innocent citizens, "mistake" or not. If the stakes are THAT high in a flawed system, that's sytem needs to be AT LEAST suspended or done away with for good.
Besides, look up a list of the other countries that still have capital punishment. We're in pretty shitty company.

i looked at this observation and felt it was incomplete. it should have read:
"giving the government the power to take the lives of its citizens who are found guilty in a court of law"
i feel it is more to the point and has a slightly different affect. i agree with you wholeheartedly about the 'one innocent person being put to death is one too much' but on the other hand like in war, people are sacrificed for a higher purpose. Generals lead their soldiers into battle knowing many will be killed, for the soldiers killed it can 'in my mind' be considered a random Death Penalty.
Some states feel they are serving a higher purpose and hopefully deterring people from making the decision to kill and if they do and are found guilty in a court of law, it becomes an even exchange.
to me it's an issue where there is no perfect solution and can be argued evenly on both ends...

More to the point, I don't feel that the death penalty is a worse punishment than life in prison. If Timothy McVeigh were with the general prison population right now, I can assure you that his punishment would be far worse than his Mint Chocolate Chip ice cream followed by a booster shot.
