I haven't seen the story reported much over here, but in Australia, a big labor union came outr a few days ago making the same point.
They said that forcing employees to listen to Christmas music all day amounted to, get this, "Psycho-Terrorism".

I was in JC Pennys this Sunday and they had it on non stop, then, I heard this crackle and something happened and there was this loud hum that just didnt stop..mmmmmmmm , I felt like my fillings were gonna fall out. I was on line and stuffed a tissue in my ears to block it.
