About a week and a half ago I got a ticket in New Jersey for failing to stop at a stop sign. At the time I got the ticket I had no idea which stop sign the officer was even talking about. The next time I was out there I saw the sign and I remember stopping there. What I want to know is, is it worth it to fight the ticket. What are the ramifications I face if I get a ticket in another state. I live in New York. Do I get points on my New York license? I don't know if I should fight it, or just pay the ticket. If I pay it and I get points on my license I'll want to take a defensive driving course then to reduce the points. I have a good driving record and I don't want this to screw me up. But I don't know what to do.

and in the long run, that class will actually lower your insurance when the points go away

If you're sure you're right, you really should fight it. If you accept the ticket, it can end up costing you a lot more than the face value of the ticket, especially if you end up getting another ticket or an accident in the next three years. There are a lot of resources (books, websites) out there that can give you ideas of how to best present your case. Best of luck.

well the question i have to ask was: was the stop sign obscured in any way?
Ultimately i would say to just get a lawyer, even some back alley lawyer to take the case; at the very least theres a good chance you could have it plead down to no points and maybe just court costs.
On the better side, that intersection may have a history of problems and you may get away with a whole lot of nothing against you.

I just called my insurance company and they told me that since I took a defensive driving class last year I have to wait 2 years before I could take another to get those points taken off my license. I don't think I want those points so I might have to fight it. I might still lose, but I don't know, if I won I could end up with none.

reef it aint worth it. with no proof you cant win, plus you'll pay a lawyer. also, taking points off your license means its further from gettin suspended. insurance gives you points seperate from that, so even if you take the class, youll pay a surcharge for points. trust me, im still payin points and havent had any in 3 years.

just pay it, and pay the 100 extra a year, its still cheaper than court and lawyer fees will be for a dead end case you prob cant win

Reef,
I don't know if it is still true. but as of 5 years ago, if you pay the ticket and there is no intra-state cooperation, it is like it never happened.

I got popped in PA and NY, mailed the checks out the next day, and NJ never got a word about it. They just want the money.
Like I said, I don't no about the current SCMODS (State County Municipal Offender Data System), but ask your lawyer

I was under the impression that this is the type of thing that you do without a lawyer. Am I wrong?

I am just saying, if you are friendly w/ your lawyer, and he is willing to give you some (free) advise, you can see if one state reports violations to another state.
Generally, if the fine is paid right away, they will call it case closed. These morons would rather not have to go through the bullshit of contacting another states DMV. And definitly not when it is time for their break.

I say pay the fine, and I think it will go away.

Hey, I think I'm in the clear if I just pay it - unless I'm reading this info from the NYS DMV website...

If I get a ticket for a moving violation in another state, do I receive points on my NYS driver license?

The NYSDMV does not record out-of-state violations committed by NYS drivers in other jurisdictions. The exceptions are alcohol-related violations, drug-related violations, and moving violations committed in Quebec or Ontario. Under special agreements, traffic convictions in Quebec or Ontario are recorded on NYS driver license records and carry points. Except for violations in Ontario and Quebec, points are not added to your NYS record for out-of-state violations.

Disregard everything I said before (as if you hadn't already!), If the NYSDMV doesn't record out-of-state violations, you're home free. That's a break.

Does anyone know if NJ traffic courts will reduce the cost of the ticket if you show up to enter a plea, even if it's guilty? They do that out here. Although it might not be worth the time off work.

No, the fine is pretty much set in stone. Just pay it, and be done w/ it.

The deal is, if you pay it right away, you are good. Otherwise, if it gets into the system, warrents are served, the county sheriff gets involved, and you are officially served. You must pay these things before they get into the system. You don't want to be suspended , and they will do it.

I was gonna say, if you go down to pay it and the cop doesnt show up, it might have an effect on the fine. Oh well.

Too bad I'm late for this thread...

Reef, most municipal courts in Jersey are so damn filled that if you show up on your court date for a minor moving violaton like this, the prosecutor will usaully speak with you before the case and turn it into a no-points offense, and sometimes reduce the fine (plus court costs).

Although the NY system doesn't put the points on your license from out of state offenses, had you appeared in court, you may have paid less.

And if the cop doesn't show up on the court date, they usually drop the violation entirely.

I spoke to the NYS DMV office and they told me that if it didn't happen in New York State then they won't know anything about it. There will be no points on my license. In all likelyhood it won't affect my insurance as well since they don't generally check out of state records if they don't have any reason to.

So rather than lose a days pay and lawyers + court fees I just paid it, it was $80 so it's ultimately cheaper in the long run.

As someone who used to work in Jersey and live in NY, just pay the ticket and be done. Your time spent going out to Jersey and sitting in the court to lower the fine is worth more than the amount you'd save on the ticket. Points don't transfer, so who gives a fuck?

Reef.. you have nothing to worry about. The first ticket for a minor moving violation does not affect your insurance.

Fight it. get a hearing date then call to put it off once or twice. that way even if you are found guilty, you may miss a few insurance payments with the pionts on it. It will still be cheaper.

The clock on insurance points does not start until you are convicted (the ticket is paid) and you cannot be charged for a ticket until four months after conviction. So the best thing to do is finish it right away. The longer you wait the longer the ticket will affect your insurance.
