This shouldn't affect NY, which has its own DNC registry, however, I assume.

No doubt some right guaranteed in the Constitution. Once upon a time judges would throw cases like this out of court.
It's time for a Constitutional Convention and term limiting judges. Anything else, of course, they would throw out as unconstitutional.

Direct Marketing Association Inc., one of the plaintiffs, said it was happy with the ruling, even though it "acknowledges the wishes of millions of U.S. consumers who have expressed their preferences not to receive telephone-marketing solicitations - as evidenced by the millions of phone numbers registered on the FTC list."

i work for a direct marketing company, and they just updated our database and programs in order to comply with the do not call list. not sure how we'll be handling this now.

Maybe we don't need different parties in power in Washington to make sure nothing gets done. Judges will simply overrule everything that will affect our lives.

It was tough for me in my telemarketing days lemme tell ya.
I tried to sell telephones, but everyone I spoke to said they didn't need one. go figure.

The judge did have a valid point. It's not the FTC's job to regulate phone calls. It's up to the FCC. If the FCC wants to put together a do not call list, then it'll stick.

But telemarketing is commercial speech, so either one should be able to set this up, or they can tag team. I don't care who does it, I just want this thing to work or I'm getting an airhorn next to my phone.

No Se7en, voting is exactly the point. You need to vote for the party you agree with most so that while they're in power, they appoint judges that think more like them. And then vote others into office that won't block appointments.

As I learned in my insanely boring Administrative Law class today, Congress is actually passionate about this list so they're going to rewrite some of the FTC's enabling act and give them the mandate to govern the list.
Don't worry, the telemarketers are STILL going to be fucked over, it may just take a few more months to get the job done.
