Opie & Anthony Case May Set New FCC Precedent

"This could be a tipping point in content control," attorney John Garziglia told the crowd at the FCC Rule Enforcement NAB session, noting that the "sex in church" stunt that got them fired could lead the FCC to set restrictions on offensive broadcasts against certain "protected groups" such as race, religion and children. However, he also said the FCC may have a hard time proving the infamous Opie & Anthony broadcast was actually indecent. Noting that about half of the broadcast's transcript focuses on an argument between the O&A sidekick who phoned in the incident and a church security guard, Garziglia said the content could be considered "more a social commentary on the Catholic church than it is a discussion of a sexual act." Still, he believes it was "absolutely a tasteless stunt." Attorney David O'Neil agreed that the FCC may have a hard time actually making a case for indecency.

Let's hope they can prove nothing. If it were up to the FCC and/or the Church, censors would kill talk radio altogether. Back to Imus, 1975. Yikes!

If they can't prove indecency then there would be no grounds for O&A's cancelation and Infinity could bring them back.

But the whole "protective groups" thing is straight up censorship and hopefully would never pass.

Thye Catholic Leagus had every right to get upset, protest, boycott, call for O and A's heads, whatever. I don't have a problem with that. As soon as the government gets involved and stats passing judgement, this is when it gets scary.
