Husband May Face Charges in Texas Drowning Case

HOUSTON (Reuters) - Texas prosecutors are considering whether to file child endangerment charges against Rusty Yates, whose wife was sentenced to life in prison for drowning their five children while she was in a psychotic state, according to news reports Monday.

Harris County District Attorney Chuck Rosenthal said he assigned a prosecutor to the case after receiving numerous e-mails suggesting Rusty Yates shared culpability for the crime, according to television stations KTRK, an ABC-TV affiliate, and KHOU, a CBS-TV affiliate.

Andrea Yates, 37, was sentenced to life in prison for drowning the children in the family bathtub on June 20 in what she said was an attempt to save them from the devil. The jury in her month-long trial rejected her plea of not guilty by reason of insanity.

The mother and siblings of Andrea Yates have suggested that Rusty Yates was selfish and controlling and drove his wife to her insane act. In post-trial interviews, they supported the idea of possible charges against him.

A doctor testified during Andrea Yates' trial Rusty Yates was warned that if his wife became pregnant with a fifth child she could sink into a severe postpartum depression. After an earlier pregnancy, she attempted suicide.

Yates, a 37-year-old NASA engineer, blamed incompetent doctors and health insurance limitations for the crime, saying they did not treat his wife's condition.

Neither he nor Rosenthal could be reached for comment.

Under Texas law, the charge of child endangerment requires that someone intentionally and knowingly place children in danger. It carries a maximum penalty of two years in jail.

Good! i think this guy is just as guilty as the wife is, they should both rot in prison for a very, very long time. why we aren't killing them is beyond me.

one word Liberals....

these people protest everything. granted some of their protest are needed.. these are the same people who feel that and unlimited amount of appeals for the death sentance is a good thing, then blame leg. for rising taxes in states with the death penalty... if you kill your five kids who were to small to fight back, fuck that put a bullet in that persons head.. they don't deserve to live....

if this guy knew that his wife was suffering from depression and was a danger to herselfr and others around her. why wouod you leave children with her unsupervised? this guy maybe guilty of child endangerment or more.

i dont agree with the death penalty but i wont start that argument here. but the father does deserve jail time for his failure to act and protect his children. They've already established she tried to commit suicide and they were warned against having more children. some people just shouldnt breed. <P>

so, he was told that if she got pregnant again (the fifth time) she'd be extremely worse than she was before. what's he do about that? get her knocked up again.

and he knew she was severely unstable and still left children in her care alone. that's a problem. he's just as responsible for what happened to his kids as his wife is. he should rot in prison for life too.

Wait a minute. Who was going to work for this family?? I dont know how you can say that he should have of been there...number one the key phrase is that he was a NASA engineer, so he was probably working long hours trying to support his family

Come on lets be realistic about this situation, we only do have one side of the story and have said that this guy is guilty...we dont know what the facts are and are only told maybe ten percent by the liberal media...lets find out the truth before we go pointing fingers

To compound his culpability, he insisted his mentally unbalanced, emotionally unstable, depressed, psychotic wife home-school their children - whom she didn't want in the first place. I wonder why she snapped?

It's criminal to allow him to walk away scott-free.
